Promise Hills Health Guarantee & Spay Neuter Contract
(This is just a copy of the details of the contract. Both Breeder and Buyers contact info, puppy info, and price will be listed on contract when you take home your puppy. There will be 2 copies of the contract provided by the breeder, one for breeder and one for Buyer, to sign and date when picking up your puppy)
~Breeder guarantees this puppy to be presented in good health at the time of purchase, to have had its first set of vaccinations, de-worming, and health check by a licensed veterinarian. Vaccination & health records will be provided to the buyer. It is recommended that the buyer take the puppy to their own licensed vet within the first 72 hours of purchase. This will verify(by a second vet) that your puppy is in good health. If the puppy is found to be in poor health, the puppy will be replaced with one of equal value as soon as one becomes available. Buyer MUST notify the seller within 72 hours of purchase date, and supply written verification and confirming reports from the licensed veterinarian. Puppy must then be returned as soon as possible. Failure to return pup in an appropriate amount of time may result in a loss of a replacement pup for the buyer. Breeder is not liable for any vet expenses incurred by seller, costs related to the returning, and the returning of said puppy. If a buyer chooses NOT to take the puppy for a second vet check within the 72 hours, it will be assumed that the buyer agrees that the purchased puppy was in good health at the time of purchase, and a replacement pup will not be given on a claim of poor health. If buyer chooses NOT to take the puppy for a second vet check within 72 hours of purchase, the rest of the contract, including the 2 year hereditary debilitating health defect portion IS STILL VALID.
~Breeder guarantees against hereditary debilitating health defects of the puppy purchased for a period of 2 years from the date of birth. These conditions must be debilitating, affecting the quality of life, or resulting in death, for the guarantee to be valid. Veterinarian costs, medicines, or autopsy expenses will not be covered by the breeder. Written verification and confirming reports from a licensed veterinarian will be warranted within 14 days of diagnosis. Puppy will be replaced with one of equal value as soon as one becomes available. It is the buyers responsibility to pay for any costs related to the returning or the receiving of a pup. eg. flight, fuel costs. Cash refunds will not be given. An occasional exception to this may apply, but this would be the choice of the breeder. At no time shall the refund exceed the purchase price of the pup.
~Buyer agrees to spay/neuter this puppy within 6-12 months of age -on or before puppy's 12 month birth date. Buyer must provide the breeder with documents to verify this spay/neuter no later than 1 week of the spay/neuter deadline. Documents must be obtained by a licensed vet, must clearly state the veterinary clinic, clinic phone #, signature of the vet, date, and the breed, microchip #, and sex of the puppy. Any failure to spay/neuter, or provide vitrifying documents by the deadline will result in no genetic health guarantee for this puppy. The ONLY exception for a delayed spay/neuter would be if this would put the puppy at risk by doing the spay/neuter for reasons such as injury, heat cycle started, or other valid reasons-vet MUST verify this in writing and verification MUST be sent to breeder before the spay date for the remainder of the genetic guarantee to apply. An estimated safe future spay date must also be provided by the vet, and at that time, procedure must be done and verifying documents must be sent to breeder. If puppy has been found to have been used for breeding, accidental or not, puppy will be surrendered back to the breeder and a $2000 fine will be issued.
~Buyer must NOT re-home puppy before contacting the breeder and giving breeder first rights to take the puppy back. If buyer can not keep the puppy, for whatever reason, the breeder will have first rights to take the puppy back, or may assist in finding a new home for the puppy. This contract applies to the puppy at any stage in his/her life, no matter the age. If breeder takes puppy back, a partial refund may be given for the puppy. Refund on a puppy will depend on such factors as age of puppy, condition of puppy-mental and physical, and if puppy vaccinations are up to date. The deposit payment on a puppy is not refunded. The refund will be fair and buyer will have no say in the amount they will be refunded for a returned puppy. If there is found to be any mistreatment or neglect of the puppy, a refund of any kind will not be given, and puppy will be surrendered back the breeder. If puppy is seen advertised for sale and breeder had not been contacted and given first chance to take back the puppy, puppy will be surrendered to the breeder with NO refund of any kind. If puppy has been found to have already been sold and breeder was not contacted, a fine to the original owner will also be issued for the amount $2000. If puppy has been found to have been placed in a shelter, pound, etc without breeder being notified to take the puppy back, a fine of $2000 be issued.
~Buyer agrees to provide second, and third puppy vaccinations, rabies vaccination, de-wormings as necessary, and boosters as necessary. (first puppy vaccination is done before puppy leaves the breeder, second shots are due 3-4 weeks after the first, and third shots are due 3-4 weeks after the second. A booster shot is needed 1 year after the last puppy shot. De-wormings are usually done at the same time as the shots, or as deemed necessary as young pups may need de-wormings done sooner than the 3-4 week intervals.) It is recommended that the buyer does their own research on the over vaccinating of pets. After the initial adult booster shot, additional booster shots may not be necessary to repeat every year and may actually be detrimental to your pet's health. (I strongly recommend doing booster shots no sooner than every 3rd year, some say no additional boosters are needed as lifelong immunity is established after the initial booster, but please do your own research.) Please note that puppy replacement guarantee may not be applicable if the second and third puppy vaccinations are not up to date with verifying records.
~Buyer agrees to assure a quality of life for this puppy, to provide adequate food, shelter, water, to love, and to care for this puppy. If puppy is found to be mistreated, neglected, or abused, puppy will be surrendered to the breeder. No refund of any kind will be given.
*Payment must be made in full upon receiving of puppy, if flown, at least 4 days prior. Additional expenses will be charged for puppies not picked up by 10 weeks of age, or possibly puppy may be placed back up for re-homing and original buyer's deposit will be lost.
*Breeder reserves the right to revoke this agreement and cancel any pending sale should there be any concerns or uncertainty regarding the prospective buyer's ability to adopt a puppy.
*Any disputes with this contract will be dealt with in a court of law of the breeders jurisdiction. If taken to court, buyer will be responsible for all court costs, including those incurred by the breeder.
